“Big Legal Move Coming from Telangana Government!”

The Telangana state government has decided to approach the Supreme Court on BC reservations. Congress leaders held a Zoom meeting on the issue of going to the Supreme Court to implement GO 9. They spoke to Supreme Court lawyer Abhishek Singhvi and decided to approach the Supreme Court on the stay given by the High Court stopping the implementation of the GO and the election notification for 42 percent reservation for BCs in local body elections.

A special leave petition will be filed on this. It will request that the stay given by the High Court be lifted and the elections be allowed to be held. The state government will argue in the Supreme Court that the High Court’s interference in this is inappropriate since the election process and the acceptance of nominations have also begun.

It will bring to the attention of the court the fact that a survey was conducted on population statistics in accordance with the Supreme Court verdicts and 42 percent reservation was provided as the BC population is 57.6 percent, and the law was amended accordingly by amending the reservation limit.

A copy of the High Court’s verdict came on Friday midnight.  Even if the copy is not received, there are chances that the Supreme Court will be asked to urgently hear the special leave petition seeking exemption.

The government is said to have discussed three options: should it go to the Supreme Court? Or wait until the Supreme Court’s verdict on the issue of setting a deadline for the President and Governors to clear the bills? Or give 42 percent tickets on the basis of party affiliation.  However, it is reported that it is better to go to the Supreme Court.

Meanwhile, the High Court has clarified that the Election Commission can go ahead with the local body elections that have expired as the government has stopped the orders issued by it providing 42 percent reservation to BCs. It has been said that the reservation should not exceed 50 percent. Accordingly, since this court has stopped the 42 percent G.O., it has given clarity that proportional seats can be notified under the open category and local body elections can be moved forward.
